Terms of Service
Last updated 2 September 2026
1. Acceptance of these terms
By downloading, installing, accessing, or using the BudgetKin mobile app or website (together, the “Service”), or by accepting these terms when you create an account, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use the Service.
These Terms form a binding agreement between you and Swales Collective LTD, the company that operates BudgetKin (“we”, “us”, “our”), and are governed by the laws of England and Wales.
BudgetKin is a trading name of Swales Collective LTD, a company registered in England and Wales (company number 17283111), with its registered office at 142 Somerset Road, Almondbury, Huddersfield, England, HD5 8HY.
2. What BudgetKin is — and what it is not
BudgetKin is a budget planner. You tell it what is coming in, what is already committed to go out, and what you intend to spend; it works out what is left. Every figure in the app is a forward-looking plan built from what you entered.
Because of that, and this is central to how the Service works:
- BudgetKin never connects to your bank. It has no Open Banking connection, no card link, and no access to any account of yours.
- It never shows a balance and never lists transactions. It cannot tell you what you actually hold or actually spent — only what your own plan says.
- It does not move money. It makes no payments, transfers, or savings deposits on your behalf.
- Its figures are only as accurate as the information you enter and keep up to date. A bill you forgot to add is a bill the plan does not know about.
BudgetKin is not a bank, and we are not authorised or regulated by the Financial Conduct Authority. See clause 10 for the position on financial advice.
3. Who can use BudgetKin
The Service is intended for people aged 18 or over. By creating an account you confirm that you are at least 18 and have the legal capacity to enter into these Terms.
We may refuse, suspend, or withdraw access, or close any account, where we reasonably believe these Terms have been breached or where doing so is necessary to protect the Service or other users.
4. Your account
You are responsible for:
- Keeping your password and account credentials secure and confidential
- All activity that takes place under your account
- The accuracy of the income, outgoings, contract dates, and budgets you enter
You must not share, sell, or allow anyone else to use your account. If you believe someone else has accessed it, contact us at hello@swalescollective.co.uk immediately.
5. Licence to use the Service
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service for your own personal, non-commercial use. We reserve all rights not expressly granted. You must not copy, modify, sell, rent, sublicense, distribute, reverse engineer, or commercially exploit the Service, except as expressly permitted or as cannot be excluded by law. This licence ends automatically if you breach these Terms.
6. Free access and premium subscription
- The core planner — your income, your outgoings, your budgets, and what is left — is free to use.
- Premium is not on sale yet. Everything the app currently offers, including exporting your plan, is free. The terms below describe how a subscription will work once one is available; until then there is nothing to buy and nothing to cancel.
- Premium will unlock additional features. The features included are described in the app at the point of purchase and may change over time.
- Prices are shown in the app in your local currency, formatted by the App Store or Google Play, and include any applicable taxes. The price shown to you at the point of purchase is the price that applies.
- Subscriptions are billed in advance and renew automatically unless cancelled at least 24 hours before the end of the current billing period. Payment is taken through your Apple ID (App Store), your Google Play account, or, for web subscriptions, our payment provider Stripe.
- You can cancel at any time in your Apple ID settings, your Google Play subscriptions, or your web account. Cancellation takes effect at the end of the current period and, except where required by law, we do not refund partial periods.
Refunds for App Store and Google Play purchases must be requested from Apple or Google, as they are the merchant of record for those transactions. For web subscriptions, contact hello@swalescollective.co.uk. Nothing in this clause affects your statutory rights as a consumer, including any 14-day cancellation right under the Consumer Contracts Regulations 2013 where it applies.
Deleting your account does not cancel a store subscription. Apple and Google hold the subscription, not us, so you must cancel it separately in your App Store or Google Play settings to stop being billed.
7. Reminders and notifications
Where you turn them on, BudgetKin sends push notifications and reminders — for example, that a fixed-term contract you recorded is coming to an end. These are generated from the dates you entered and are a convenience, not a guarantee: notifications can be delayed, suppressed by your device, or missed entirely. You remain responsible for tracking your own contract end dates, notice periods, and renewals. You can turn reminders off at any time in Settings.
The same reminders can also be sent by email, if you switch email reminders on. They go to the email address on your account and nowhere else — we do not email anyone you add to your household, and we never ask you for their contact details. Every one of these emails carries an unsubscribe link, and unsubscribing stops the emails without closing your account or changing your plan. Email delivery is outside our control and is subject to the same no-guarantee position as push: treat a reminder as a helpful prompt, never as your record of a deadline.
8. Suggestions, deals, and third-party offers
BudgetKin may highlight that a contract is ending and, in future, may show related offers or switching suggestions from third parties, in the app and in the reminder emails described in clause 7. Any such offer is a matter between you and the provider concerned, on their own terms. We do not guarantee that any offer is the best available to you, and where we are paid a commission or fee for a referral we will say so. Always check a provider’s own terms before switching.
9. Intellectual property and your content
All content within the Service — including its software, design, text, illustrations, trade marks, and branding — is owned by or licensed to us and protected by law. You may not use it except under the limited licence in clause 5.
You keep ownership of the plan data you enter (your income, outgoings, budgets, and notes). You grant us a worldwide, royalty-free, non-exclusive licence to host, store, back up, and display that data solely in order to provide the Service to you. If you send us feedback or suggestions, you grant us a perpetual, royalty-free licence to use them for any purpose.
10. No financial advice
BudgetKin is an organisational tool. Nothing in the Service is financial, investment, tax, debt, or legal advice, and nothing in it is a personal recommendation. The figures it shows are arithmetic performed on the information you entered.
Decisions about your money remain yours. If you are struggling with debt or need advice about your circumstances, speak to a qualified adviser or a free service such as MoneyHelper or Citizens Advice. To the fullest extent permitted by law, we are not responsible for financial decisions you take in reliance on the Service.
11. Availability and accuracy
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind. We do not warrant that it will be uninterrupted, error-free, or that any projection it produces will prove correct. The app stores a copy of your plan on your device so it works without a connection; if a device is lost, wiped, or its storage cleared, unsynchronised changes may be lost.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, savings, or goodwill. Our total aggregate liability for all claims relating to the Service or these Terms shall not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) £50.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. Nothing here affects your non-excludable statutory rights as a consumer.
13. Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose
- Attempt to gain unauthorised access to the Service, other accounts, or our systems
- Scrape, copy, or redistribute the Service or its content without our written consent
- Resell, mirror, or make the Service available to any third party
- Impersonate another person or misrepresent your affiliation with anyone
- Introduce malicious code or otherwise interfere with the Service’s operation
We may suspend or terminate accounts that breach these Terms.
14. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Swales Collective LTD and its officers, employees, and contractors from claims, liabilities, damages, and reasonable costs (including legal fees) arising from your breach of these Terms, your misuse of the Service, or content you submit — except to the extent a claim arises from our own negligence or breach.
15. Third-party platforms
The Service relies on third parties including Apple, Google, Supabase, and Stripe, whose own terms apply to their services. Where you obtain the app from the Apple App Store, you acknowledge that these Terms are between you and us only (not Apple); that Apple has no obligation to provide support or warranties for the app; that Apple is not responsible for claims relating to the app, including product-liability or intellectual-property claims; that you are not located in an embargoed country or on a US restricted-parties list; and that Apple and its subsidiaries are third-party beneficiaries of these Terms.
16. Changes to the Service
We may update, modify, suspend, or discontinue all or part of the Service at any time. Where a material change adversely affects a paid subscription, we will give reasonable notice and, where appropriate, the option to cancel without penalty.
17. Changes to these terms
We may revise these Terms from time to time. If we make material changes we will notify you in the app or by email before they take effect, and may ask you to accept the revised Terms. Continued use after the effective date constitutes acceptance.
18. Ending your account
You may delete your account at any time from Settings in the app, or at budgetkin.app/delete-account. Deletion is permanent: your plan and everything in it are removed and cannot be recovered. As set out in clause 6, it does not cancel a subscription held by Apple or Google.
We may suspend or terminate your access immediately if you breach these Terms, if required by law, or to protect the Service or other users. On termination your licence ends and you must stop using the Service. Provisions that by their nature should survive termination will continue to apply.
19. General
- Governing law: the laws of England and Wales apply and its courts have exclusive jurisdiction, except that consumers resident elsewhere may benefit from mandatory local protections.
- Severability: if any provision is unenforceable, the rest continue to apply.
- No waiver: not enforcing a provision does not waive our right to do so later.
- Assignment: you may not assign these Terms without our consent; we may assign them to a successor or affiliate.
- Entire agreement: these Terms and our Privacy Policy are the entire agreement between you and us regarding the Service.
